Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Baristica mobile application and related services (“Services”) provided by Baristica (“we,” “us,” or “our”). By creating an account, accessing, or using the Services, you (“you”) agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business.

You are responsible for:

  • Providing accurate registration and profile information
  • Maintaining the confidentiality of your credentials
  • All activity under your account

Notify us promptly at support@baristica.az if you suspect unauthorised access.


2. Licence to use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, in accordance with platform rules (Apple App Store, Google Play, etc.).

You will not:

  • Copy, modify, distribute, sell, or lease any part of our software except as permitted by law
  • Reverse engineer or attempt to extract source code except where prohibited prohibitions do not apply
  • Interfere with or disrupt the Services, servers, or networks
  • Attempt to access accounts or data belonging to others
  • Use the Services to violate law, third-party rights, or platform policies
  • Submit malware, excessive automated traffic, or abusive content
  • Use AI or messaging features to generate unlawful, harmful, or infringing content

We may suspend or terminate access for breach or risk.


3. Orders, products, and payments

Catalogue and availability. Product listings, images, descriptions, and prices are presented as available at the time shown. We may modify offerings, limit quantities, or refuse or cancel orders in case of errors, suspected fraud, supply issues, or legal requirements.

Fulfillment. Delivery, pickup, timing, and logistics depend on the options shown in the App and operational capacity. Risk and title pass as determined by applicable law and our stated checkout terms at the time of purchase.

Payments. Where online payment is offered, payments are processed by our payment processors (such as E-point or others we identify at checkout). You agree to comply with their terms. We may store payment statuses and references as needed to operate the Services and meet legal obligations—we do not intend to store complete card data on our servers.

Points and promotions. Points, discounts, or promotions may be governed by additional rules shown in the App. We may change or discontinue promotions; points may expire or reset as described in-product.

Wholesale / tiered access. Certain prices or features may be limited to approved wholesale or tier accounts. We may verify eligibility and adjust access.


4. User content and licence

The Services may allow you to submit content (brew notes, quiz answers, AI prompts, profile fields, reviews if offered, etc.). You retain ownership of your content to the extent you hold rights in it.

You grant us a worldwide, royalty-free licence to host, store, reproduce, display, and distribute your content solely as needed to operate, improve, promote, and secure the Services (including internal analytics on aggregated or de-identified data where permitted).

You represent that your content does not infringe intellectual property or privacy rights of others, violates law, or contains unlawful material. We may remove content that violates these Terms or is otherwise objectionable, and cooperate with authorities where required.


5. AI assistant disclaimer

If provided, the AI assistant gives informational outputs only. It is not professional advice (medical, nutritional, legal, financial, or safety-critical). Coffee preparation involves heat, pressure, and equipment—follow manufacturer instructions and exercise judgment.

We do not guarantee accuracy, completeness, or fitness for a particular purpose of AI-generated content. Use at your own risk.


6. Intellectual property

We and our licensors own the Services, branding, design, and content we provide (excluding your user content). Except for the limited licence above, no rights are granted. “Baristica” and related marks are ours or our licensors’.


7. Third-party services and links

The Services may integrate or link to third parties (Supabase, Expo, payment providers, maps, etc.). Their terms and privacy policies apply. We are not responsible for third-party services.


8. Beta features and changes

We may release beta or preview features that are experimental. We may change, suspend, or discontinue any part of the Services with or without notice where reasonable; when required by law we will provide appropriate notice.


9. Disclaimers

To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.


10. Limitation of liability

To the maximum extent permitted by law, we and our affiliates, directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising out of or related to the Services or these Terms.

Our aggregate liability for claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid us for the Services in the six (6) months before the claim (excluding amounts passed through to processors for goods), or (b) fifty (50) euros, except where liability cannot be limited by law.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.


11. Indemnity

You will defend, indemnify, and hold harmless Baristica from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or breach of these Terms, except to the extent caused by our wilful misconduct.


12. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach, risk, legal compliance, or discontinuation of the Services.

Sections intended to survive (including intellectual property, disclaimers, limitation of liability, indemnity, governing law) will survive termination.

Account deletion. Where the App offers deletion, follow in-app instructions. Some information may be retained as described in the Privacy Policy.


13. Governing law and disputes

Unless mandatory local law provides otherwise, these Terms are governed by the laws applicable in the place of establishment of Baristica as designated in commercial communications, without regard to conflict-of-law principles.

Courts with jurisdiction over that location have exclusive jurisdiction, subject to non-waivable consumer rights in your country.

If you are a consumer in the EEA or UK, you may benefit from mandatory protections and local dispute resolution avenues.


14. Export and sanctions

You represent that you are not located in a sanctioned jurisdiction and will not use the Services in violation of export control or sanctions laws.


15. Miscellaneous

Entire agreement. These Terms and the Privacy Policy constitute the entire agreement regarding the subject matter.

Assignment. We may assign these Terms; you may not assign without our consent.

No waiver. Failure to enforce a provision is not a waiver.

Severability. If part of these Terms is invalid, the remainder stays in effect.

Language. If we provide translations, the English version prevails to the extent permitted by law in case of inconsistency.


16. Changes to these Terms

We may modify these Terms by posting an updated version with a new Last updated date. Continued use after changes become effective constitutes acceptance, except where increased obligations require separate consent under local law.
